Terms of Use

Please read these Terms of Use ("Terms") carefully before using the Pumpkin Health mobile application (the "App") operated by Grantum Labs ("we," "us," or "our"). By accessing or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms.

1. Acceptance of Terms

By downloading, installing, or using the App, you agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms, do not use the App. Your continued use of the App following any changes to these Terms constitutes your acceptance of those changes.

2. Use License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial use on any Apple device that you own or control, subject to the Apple App Store Terms of Service.

You may not:

  • Copy, modify, or distribute the App or its content
  • Reverse-engineer, decompile, or attempt to extract the source code
  • Use the App for any unlawful or unauthorized purpose
  • Attempt to interfere with, compromise, or disrupt the App's systems, servers, or infrastructure
  • Remove any copyright, trademark, or proprietary notices from the App
  • Use the App in any manner that could damage, disable, or impair the App or interfere with any other party's use of the App

3. User Accounts & Responsibilities

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate, current, and complete information when creating an account and to keep your information up to date.

You must notify us immediately if you become aware of any unauthorized use of your account or any other breach of security. We will not be liable for any loss or damage arising from your failure to protect your account credentials.

4. User Content

You retain ownership of any data you enter into the App, including pet health logs, weight entries, and profile information. By using the App, you grant us a limited, non-exclusive license to store, process, and display this data solely for the purpose of providing the App's services to you. You are solely responsible for the accuracy and completeness of any data you enter.

5. Pet Sharing & Invitations

The App allows you to share pet profiles with other users via invitation links. When you share a pet profile, the invited user will be able to view and contribute to that pet's health data. You are solely responsible for managing who has access to your pet's profile and for any data entered by shared users.

6. Intellectual Property

The App, including its design, features, content, graphics, and underlying code, is the exclusive property of Grantum Labs and is protected by copyright, trademark, and other intellectual property laws. The Pumpkin Health name, logo, and all related marks are trademarks of Grantum Labs. Nothing in these Terms grants you any right to use any of our trademarks, logos, or branding.

7. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that the App will be uninterrupted, error-free, secure, or free of viruses or other harmful components. We do not guarantee the accuracy, completeness, or timeliness of any data stored or displayed by the App.

8. No Veterinary or Medical Advice

The App is intended for informational pet tracking purposes only and does not provide veterinary or medical advice, diagnosis, or treatment. The health data tracked in the App is based solely on user input and should not be relied upon as a substitute for professional veterinary care. Always consult a qualified veterinarian regarding your pet's health. We are not responsible for any decisions made or actions taken based on information tracked in the App.

9. Data Accuracy & Availability

While we take reasonable measures to protect and preserve data stored in the App, we do not guarantee that data will always be accurate, available, or preserved. You acknowledge that data may be lost due to technical failures, service interruptions, or other circumstances beyond our control. We recommend that you keep independent records of any critical health information.

We reserve the right to modify, suspend, or discontinue the App (or any part thereof) at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the App.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL GRANTUM LABS, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, LOSS OF GOODWILL, OR ANY OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE APP, REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE), EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE APP EXCEED THE AMOUNT YOU PAID US, IF ANY, IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify, defend, and hold harmless Grantum Labs and its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of or access to the App; (b) your violation of these Terms; (c) your violation of any third-party right, including any intellectual property or privacy right; or (d) any data or content you submit or share through the App.

12. Dispute Resolution & Arbitration

Any dispute, claim, or controversy arising out of or relating to these Terms or the App shall first be attempted to be resolved through informal negotiation by contacting us at support@grantumlabs.com. If the dispute cannot be resolved informally within thirty (30) days, either party may initiate binding arbitration.

Any arbitration shall be conducted on an individual basis and not as a class, consolidated, or representative action. You agree to waive any right to participate in a class action lawsuit or class-wide arbitration against Grantum Labs.

13. Termination

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the App will immediately cease. You may delete your account at any time through the App's Settings.

All provisions of these Terms which by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, indemnification, and limitations of liability.

14. Severability

If any provision of these Terms is held to be invalid or unenforceable, that provision shall be enforced to the maximum extent permissible, and the remaining provisions shall remain in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Grantum Labs regarding your use of the App, and supersede all prior agreements, understandings, and communications.

16. Changes to These Terms

We reserve the right to modify these Terms at any time at our sole discretion. We will notify users of material changes by updating the "Last updated" date at the top of this page. Your continued use of the App after changes are posted constitutes your acceptance of the revised Terms. It is your responsibility to review these Terms periodically.

17. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law provisions.
